By accessing or using Midas Media's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Services
Midas Media provides contractor marketing services including:
- Lead generation campaigns
- Video production and marketing
- Digital advertising management (Facebook, Google)
- Website design and development
- Marketing automation and CRM setup
Exclusive Territory Protection
We guarantee exclusive territory protection, meaning we will only work with one contractor per service type per geographic area. This exclusivity is maintained throughout the duration of the client relationship.
Results Guarantee
Our "10 Booked Estimates in 30 Days" guarantee is subject to the following conditions:
- Client must respond to all leads within 24 hours
- Client must follow up using our proven communication templates
- Client must provide necessary business information and materials
- Client must maintain active ad spend as agreed
If these conditions are met and we do not deliver 10 booked estimates within the first 30 days, the client will not be charged for our service fee (ad spend is separate and non-refundable).
Payment Terms
Clients are responsible for:
- Monthly service fees as outlined in the service agreement
- Direct advertising costs (Facebook Ads, Google Ads, etc.)
- Any additional services requested outside the standard agreement
Payment is due monthly in advance unless otherwise agreed in writing.
Client Responsibilities
Clients agree to:
- Provide accurate business information and marketing materials
- Respond promptly to leads generated by our services
- Maintain professional communication with potential customers
- Grant necessary access to advertising accounts and platforms
Intellectual Property
All marketing materials, strategies, and systems developed by Midas Media remain our intellectual property. However, clients have the right to use content created specifically for their business during and after the service period.
Termination
Either party may terminate services with 30 days written notice. Upon termination:
- Client will receive all campaign data and leads generated to date
- Client retains access to materials created for their business
- Any prepaid fees for unused services will be refunded on a pro-rata basis
- Ad accounts and campaigns may be transferred to the client at their request
Limitation of Liability
Midas Media is not liable for:
- Changes in advertising platform algorithms or policies
- Client's failure to convert leads into closed jobs
- Seasonal fluctuations in lead volume or quality
- Third-party platform outages or technical issues
Dispute Resolution
Any disputes arising from these terms will be resolved through good faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in Utah County, Utah.
